URGENT: Right now, Yanacocha is attacking Maxima. Listen and Act!

URGENT!! The public forces and vigilantes of the Yanacocha company have again entered the terrain of Doña Máxima Acuña Chaupe and her family.
 
IF BETWEEN ALL OF US WE CAN REBUILD THE ESCUELITA OF THE ZAPATISTA REALITY, WE CAN TAKE OUT YANACOCHA FROM THE LANDS OF DOÑA MAXIMA AND REBUILD HER HOUSE. LET’S MAKE IT SO THAT SOLIDARITY MOVES THROUGH THE LANDS OF CAJAMARCA (PERU) AGAINST CRIMINAL MINING AND BAD GOVERNMENTS. WE ARE ALL MAXIMA!! WE HAVE TO ACT NOW!
 
About two days ago, 200 heavily armed members of DINOES entered shooting into the air and destroying a house under construction on the ancestral, legitimate and legal property of this campesino family. The Yanacocha company falsely and illegally claims that the Chaupe family has usurped these lands from their property. They have charged Doña Maxima with usurpation of these lands and she was first sentenced by a judge in the service of mining. The Penal Court of Appeals of the Supreme Court of Justice of Cajamarca sentenced the appeal in favor of Doña Máxima, ratifying that these lands are indeed of this family and that, as a consequence, Yanacocha has no rights over them. Ignoring the Court and its decision, bypassing justice and the law, and making use of the public service as if they were (and in reality they are) private forces for their interests against the people, Yanacocha has entered Doña Máxima’s property three times since the release of the sentence in less than one month and has destroyed her house under construction. Today they enter again and the servile government has been silent and obedient to the servant of the transnationals. We call on the people and the solidarity of the world to immediately protest demanding that the Yanacocha usurpers immediately leave the lands of these families, that Doña Máxima and her family are compensated for the house damages so that she can rebuild her house and that the bought-out police traitors, the company vigilantes and the Yanacocha are imprisoned for theft, for breaking the law, threat and intimidation of an unarmed family and for destroying others’ property and assault.

URGENTE! STRONG POLICE CONTINGENT NEWLY IN THE LANDS OF MAXIMA ACUÑA
 
The police and the workers of Yanacocha mining arrived. In spite of having been judicially defeated, Yanacocha mining persists in continuing to intimidate and invading the lands of Máxima Acuña.

Through Máxima Acuña’s call to a local radio of Cajamarca, she alerted to a strong contingent of police and workers of Yanacocha mining that persists in continuing to intimidate and entering the lands of Máxima Acuña in spite of having been judicially defeated.
 
 
LA REPUBLICA: COLOSSAL ABUSE
The Case of Doña Máxima Acuña Chaupe
 
THE EDITORIAL LA REPUBLICA from yesterday referred to the case of Máxima Chaupe. The Court of Appeals of the Supreme Court of Justice of Cajamarca has declared inadmissible the resource of cassation posed by the Yanacocha company that intended to take back to square one the process against the campesina Máxima Chaupe and her family, which last December justice declared innocent of crimes of usurpation after a long process. In this way, one more time, justice impedes all pretention of displacement of this humble family with only 4 hectares of property, located in front of Laguna Azul, one of the areas that would be affected by the Conga project, converted into an emblem of an unequal battle between a modest family and a powerful company.
 
This precision was only made a few hours after the campesina denounced that police officers together with individuals from the security company contracted by the mining company destroyed the construction on her property. The police chief of Cajamarca has denied that the presence of the PNP in this incursion, an explanation difficult to believe considering that the material relation between said company and the police documented in various denunciations in the press. Hours after knowing of this judicial pronouncement, the affected family has returned to announce that police officers were found covering the boundaries and ditches that separate the lands that would be the property of Yanacocha mining and the Chaupe family.
 
The company, not recognizing the two recent judicial sentences, argues that it acts in possessive defense, an inconsistent argument in the sense that, as the facts show, the destruction of the Chaupe family’s construction made way for persons that later retreated, in an operation that was not ordered by a judge, violence was used and goods were destroyed.
 
The facts indicate that the legal part of this litigation has arrived at its end and that the family of Máxima Acuna Chaupe has been able to accredit their property as their possession, guaranteed this last part by the campesino community of Sorochuco, akin to the company, that in the moment wrote them a certificate of possession of that zone so that they formed part of it as community members.
 
What is now at stake is the respect for the judicial resolutions emanated from the authorities vested with the power to settle conflicts between private entities. This resistance against the judicial sentences is a culture of abuse that in the past had consequences in the local reputation of the company and of which have been made known various self critiques and intentions of amendment. In the means through which a propietary company of 5,700 hectares continues to attack a propertied family of 4 hectares without considering the judicial decision, the social climate of Cajamarca will not enter a process of distension. Finally, the police must show that they are on the side of the law and give clear visual and institutional signals that they have left behind all relations of favoritism that distances them from society. They must repeat the painful episode of last year in Cajarmaca that ended with the murder of the citizen Fidel Flores Vasques, a colossal abuse rejected by the whole country.
